I am starting this blog to keep all the folks investing in Real Estate informed about the pitfalls and problems of investing in India. This is also a community service for others to avoid the pain that I have gone through. Investing is central to people and Himalayan Region near Ramgarh is a Hot place due to its beauty with small town, beauty of Hills when ever they come out of Clouds and become visible.
The Story begins almost 3-3.5 years back when I visted Khabrar in Ramgarh near Nainital and was exposed to Cloud 9 Hill Town - a Property by Central Himalayan. I was sold of a dream of owning a small Villa in literally cloud 9 in a remote Himalayn Hill Town being promoted as Cloud 9 Hill Town at Ramgarh by Central Himalayan. The opportunity back then looked great of owning a small abode in clouds and I was excited that Central Hmalayan has brought this opportunity at Cloud 9 Hilltown, and I though of being smart to jump in early by buying a Villa at Ramgarh. Well that was the begining of the problems with Central Himalayan which were to come and shatter the dreams of a home in the Hills. First Central himalayan had promised to get my loan processed for the Villa at Ramgarh which took manay months and a lot of follow-up to finally get sanctioned.
Soon after paying the first Installment the problem started. First I got letters from Local folks there informing that there is acute shortage of Water in the area and hence Locals were against the Hill Twon to comeup over there. They complained and Local Authorities suspended the project. The Developer, it seems was also under fire for felling trees agaist the local laws.
The project was then delyaed for many months. The developer also advised us not to send any payment till further notice. Many months Later the request for money came in and when I approaced HDFC - the premier Indian Housing Loan Agency - I was told
a) That they cannot sanction the full loan as the proejct has not progressed well as well as the developemnt of my unit was not up to the mark.
b)They also informed me that they have stopped giving any loans for the property and for any other properties by this developer.
When I approached CEntral Himalayan, I was metup very rudely. They never gave any update on the project except for the general terms and did not provide any photographs to show the status of the project. The project was to be completed by October 2006 but is still far from complete even now.
Not only that they are now The developer is now blaiming us for the delay when in relaity they have delayed the project and even an independent assement by HDFC confirms this.
They are also forcing an interest on delayed payments when
a) There is no clause in the Agreement for the interest
b) The Delay is primarily due to poor Execution and Local issues
The developer even failed to sendout regular Demand Notes which are needed for processing loans.
I have never seen a developer who is so poorly managed and unethical. They are rude and very difficult to dela with. I am told that they have pressurazied other Villa owners and forced additional interest to them to cover themselves for the cost escalation due to their own poor planning, execution.
Now they are building a huge township there and I am worried that
a) Will the area with problems like water can be suistainable
b) I also fear that simialr unrest may comeup again leading to delays.
I am now contemplating taking legal resource and hope that others investing in ther may not go through similar fate.

I visited your blog and found it not matching with my very recent experience. I was on the way back from Ranikhet to Khathgodam. I and my family members were with me. We stoped for refreshment near Khabrar and enquired about some place where we can spend some time. Many peoples suggested me to go and stop at project site of CENTRAL HIMALAYAN LAND DEVELOPMENT COMPANY LTD. We went there and stoped for few hours. The company and its officials treated us in good manner. That prompted me to enquire more about the company. I also visited some ready cottages. The place is wonderfull and its wonderfully developed. The entire planning seems to be outstanding and world class. The civic facilities like water electricity, roads, park, club are all almost complete. Even at this stage the entire area looks heavenly. It's dream place for mankind and i miss the opportunity. I will try too not miss the next launch / scheme of the company in future. I think your views on the blog are either motivated or with some other intention and does not give the true picture about the project or profile of the company and its staff.

This is how I got fooeld into investing. I visted them and things were very rosy. However, when I invested then slowly things staring to go bad. I have letters from locals which says that Ramgarh in general has water scaracity. The project is not complete yet when 30 months have happened in October. Find out when was the fist Cottage given.
They are also charging Interest which is not mentioned in contract.
I suggest that you invest in their propery and when things do not work out join the group.

I agree with Mr. Rajiv. I also think it is a great place. I am not sure why you are having issues with Central Himlayan land Development company I know some people who have taken property there. Except for some delays due to problems beyond their control things look good and the place is heavenly.

Great experience at the site.
I was at cloud 9 in March 09 and was happy with the progress. officials at the projrct were courtious.
I would however advise the developer to ensure the marking of plots properly as any confusion at the site would give rise to un necesary inhibitions and doubts in the minds of the investors.

I have agree with Rajiv,
I and my Family own 3 cottages in the same resort. The company did go through a lot of management changes around 2007 and that's why we also had to face some inconvenience but not to the tune of what you explained. Yes, the cottages were delayed in construction but only for those who had bank issues.
I have thoroughly enjoyed my cottages ever since i got them and so have my friends and family..One look at the view from the cottage balcony and you realize that the place is worth any amount of trouble.We have even spent our last new year there and even though it was cold as a witches tit..we were provided firewood at such a nominal rate of Rs.500 only for 3 nights.Even today they don't have running water, but you hardly feel the pinch as the management is so helpful there that they arrange for a truck to fill your overhead tanks 3 times a day or as and when you require..In short my whole experience has been very good with the company and staff and even their dealings.. Let's face it..which company does not charge you escalation costs. You also have to realize that they have delivered what they promised even when they could have scrapped the whole project as the price of land suddenly shot up way beyond what they had promised a fully furnished cottage for. They may have been slow due to internal problems but they did not default in any way.. Finally, i guess it depends on what you are looking for..investment or personal luxury.

The company has come out with an advertisement in TOI Today offering plots of various sizes and also the Build up flats. The plots are being offered @ RS 6250/- per sq. yard. Since all of you seems to be well versed with the community therefore I would like to seek your specific guidance about following points
1. Is it really worth the price being asked 2. Is this a free hold land 3. How about basic facilities like water , electricity , road , market etc . Somebody mentioned about water shortage problem. The new entrants will definitely strain the existing resources further. 4. Who takes care of your property when the owner visit say once in a week or so. 5. Any maintenance charges payable on a monthly basis to care takers - if any

Like Mr. Sanjay said HDFC is not giving any loan nor bank of baroda till date. Is it really worth investing here. What's the actual cost, if you want to buy a prperty here, in cloud 9. CHLDC is offering in Rs.6250/-per sq.yd.

If it the same property that is being developed by a Delhi based construction group having vehicle showrooms also, then there is no comparison with Cloud 9.
Some people may be having their own reasons for not liking Cloud 9 project or the company , but I was there in May 2011 and specifically stayed in one of the cottages and enjoyed every minute of our stay there.

I am also one of the few who got enticed by their false promises and purchased a plot in the first phase to build a villa. Now not only is the villa lying unoccupied but also this company is raising bills for so called maintenance. I would like to form a group of property owners at Cloud 9 to expose this company and a few others with similar names that this person Rana has floated to fool investors. Then as a group this place cloud 9 can be freed from the clutches of Rana and his clan and developed into a serene colony of holiday homes. I have been at this beautiful township for the last 11 years with my plot of 600 yards and now I have built my dream retirement bungalow now. I feel obliged to the company and in particular Mr.Rana for developing such a beautiful location and holiday/retirement township. It is amazing and a mammoth task carried out over a period of 20 years. I really feel blessed.

Cloud 9 maybe a beautiful location but it is s very poorly managed project. Almost all owners have faced problems with the company and rude behavior of the staff at some point or the other. However now an RWA has been formed and will work towards improving the conditions there. Apart from the problems caused by the builder, the location itself is not very friendly. Once there is snowfall in end December, you cannot access the cottage as the roads are closed and the water freezes in the pipes.. It is too cold to even visit from nov to march because of the height. There are many other beautiful locations where one can buy land and build their own cottage to their choice of construction and architecture.
I will be going there after Diwali, most likely on 15th November. Will comment after that. I am planning to built my cottage.

The developer of Cloud9 Hill Town is a absolute cheat. I own a property at Cloud9 and bought it a while ago. I was pulled into the project by the developer by some very mesmerising promises.
But the problems started right after I started building my cottage. The developers started charging me unnecessarily and gave me large bills every year. For a while I paid them but after seeing the pathetic developments of the construction site I refused to pay any more maintenance charges. The roads leading to my plot were in poor conditions and there were no lights to drive in the night. I was promised a water connection and electricity connection which was not given to me even after 10 years of the promised date. After confronting GS Rana at the office for the same problems I faced some new issues.
I was harassed and my family was threatened at regular intervals by the builder Ganesh Singh Rana and his engaged man power. Many cases were filled by him against me and my family members. Though builder lost all these cases, he continued to harass me and other members of the society. Finally, we all thought to come together and fight against the developer with a common goal.
Those who are appreciating the work at Cloud9 are either family members of the builder or his close friends.
We have formed a RWA for Cloud9 Hill Town members who are looking to get justice through court. I would request owners of the society to join RWA and stay in touch.

Hello guys, my father also has a plot there which he purchased in Year 2006, he gets to know about this project through newspaper advertisement.
We visited there after Year 2008, First a fall the Swiss village Resort which was opened previously is now closed, then when we ask them to show our plot (As we didn't know, where exactly our plot is, no one helped us.
We are having very negative views about cloud 9 builder. Now we are searching for any potential buyer.
